PLASTIC WASTE MANAGEMENT RULES, 2016

12. Prescribed authority. –

(1) The State Pollution Control Board and Pollution Control Committee in respect of a Union territory shall be the authority for enforcement of the provisions of these rules relating to registration, manufacture of plastic products and multilayered packaging, processing and disposal of plastic wastes;

(2) The concerned Secretary-in-charge of Urban Development of the State or a Union Territory shall be the authority for enforcement of the provisions of these rules relating to waste The Plastic Waste Management Rules, 2016, management by waste generator, use of plastic carry bags, plastic sheets or like, covers made of plastic sheets and multilayered packaging;

(3) The concerned Gram Panchayat shall be the authority for enforcement of the provisions of these rules relating to waste management by the waste generator, use of plastic carry bags, plastic sheets or like, covers made of plastic sheets and multilayered packaging in the rural area of the State or a Union Territory; and

(4) The authorities referred to in sub-rules (1) to (3) shall take the assistance of the District Magistrate or the Deputy Commissioner within the territorial limits of the jurisdiction of the concerned district in the enforcement of the provisions of these rules.

16. State Level Monitoring Committee. – (1) The State government or the union Territory shall, for the purpose of effective monitoring of implementation of these rules, constitute a State Level Advisory Committee consisting of the following persons, namely; –

a) The Secretary, Department of Urban Development – Chairman

b) Director from State Department of Environment – Member

c) Member Secretary from State Pollution Control Board or Pollution Control Committee – Member

d) Municipal Commissioner – Member

e) One expert from Local Body – Member

f) One expert from Non-Governmental involved in Waste Management – Member

g) Commissioner, Value Added Tax or his nominee– Member

h) Sales Tax Commissioner or Officer – Member

i) Representative of Plastic Association, Drug Manufacturers Association, Chemical Manufacturers Association – Member

j) One expert from the field of Industry – Member

k) One expert from the field of academic institution – Member

l) Director, Municipal Administration – Chairman

The State Level Advisory Body shall meet at least once in Six Month and may invite experts, if it considers necessary.

That the following Officers shall enforce this direction in exercise of power on them by law in their jurisdiction.

a) The Commissioner, Joint Commissioners, Revenue Officers, all Health Officers and all Engineers of BBMP.

b) All Deputy Commissioners of the districts.

c) All commissioners of City Corporations, Chief Officers, Health Officers and all Engineers of urban Local Bodies.

d) All Assistant Environmental Officers, Deputy Environmental Officers, Environmental Officers and Senior Environmental Officers of KSPCB.

e) All Assistant Commissioners of Revenue Sub Divisions.

f) Tahasildars of all Taluks.

g) All Officers of Commercial Tax Department.

h) All Officers of Department of Food and Civil Supplies.

i) The Controller, Deputy Controller and Regional Officers of Legal Metrology Department.

CIRCULAR

Karnataka Government Secretariat, MS. Building, Bangaluru, Dated:30.06.2022.

The Government of Karnataka in exercise of the powers conferred under section 5 of the Environment (Protection) Act, 1986 issued the direction of imposing the ban on the use, manufacture, supply, store, transport, sale and/ or distribution of plastic carry bags, plastic banners, plastic buntings, flex, plastic flags, plastic plates, plastic cups, plastic spoons, cling films and plastic sheets used for spreading on dining table irrespective of their thickness including the above items made of thermocol and plastic which use plastic micro beads in the State, vide Notifica tion No. FEE 17 EPC 2012, dated: March 2016.

The Ministry of Environment, Forest & Climate Change (MoEF&CC) in exercise of the powers conferred under Sec tion 3, 6 and 25 of the Environmental (Protection) Act, 1986 has notified the Plastic Waste Management Rules, 2016, vide Notification No. GS.R. 320 (E), dated 18111 March, 2016 in supersession of the Plastic Waste (Management and Handling) Rules, 2011.

The Ministry of Environment, Forest & Climate Change in exercise of the powers conferred under Section 6, 8 and 25 of the Environmental (Protection) Act, 1986 has amended the Plastic Waste Management Rules, 2016 vide Notifica tion No. G.5.R 571(E), dated: 12th August,2021 which mandates banning of identified Single Use Plastic (SUP) items with effect from 1st July, 2022;

Further, as per The Rule 4(2) of Plastic Waste Management Rules, 2016 (as amended), “The Manufacture, Import, Stocking, Distribution, Sa le and Use of following Single Use Plastic (SUP), including Polystyrene and Expanded Polystyrene commodities shall be prohibited with effect from 01.07.2022.

(a) Ear buds with plastic Sticks, plastic sticks for balloons, plastic flags, candy sticks, ice-cream sticks, polystyrene (Thermocol) for decoration.

(b) Plates, cups, glasses, cutlery such as forks, spoons, knives, straw, trays, wrapping or packing films around sweet boxes, invitation cards, and cigarette packets, plastic or PVC banners less than 100 micron, stirrers;

It is reiterated now that the direction issued by the Government of Karnataka in exercise of the powers conferred under Section 5 of the Environment (Protection) Ac, 1986 of imposing ban on the use, manufacture, supply, store, transport, sale and or distribution of the said Plastic items vide notification No.FEE 17 EPC 2012, dated: 11 .03.2016 will continue to be in force in State of Karnataka, in addition to the Notification No. GS.R 571 (E), dated: 12u, August, 2021 issued by the Ministry of Environment, Forest & Climate Change (MoEF&CC).

The following officers are hereby authorized to implement this circular in their respective jurisdictions:

a) The Additional Chief Secretary to Government, Urban Development Department

b) The Principal Secretary to Government, Urban Development Departement

c) The Principal Secretary tGovernment, Rural Development and Panchayat Raj Department

d) All Deputy Commissioners of the Districts

e) The Commissioner, Joint Commissioners, Deputy Commissioners and All Public Health Officers of BBMP

f) All Commissioners and Chief Officers and Health Officers and all members of the local bodies in the State

g) All Regional Officers/ All Environmental Officers of Karnataka State Pollution Control Board;

h) The Director, Directorate of Municipal Administration

i) All Assistant Commissioners, Revenue Department

j) Tahshildars of all Taluks

k) Officers of Commercial Tax Department

l) Officers of Department of Food and Civil Supplies

m) Commissioners/Superintendent of Police;

n) General Managers, District lndustries Centre;

0) Officer-in-charge of Police Stations.

p) Designated Officers and Food Safety Officers of Food Safety Commissionerate

The Urban Development Department, the Rural Development and Panchayat Raj Department and the authorities and bodies under the said Departments and the Karnataka State Pollution Control Board shall ensure monitoring and implementation of the said Notifications.

The contravention of directions, as stated in this Circular shall be an offence committed under the Environment (Protection) Act, 1986 and Rules, Orders, Notifications framed there under and attract penal provisions as specified under section 15 of the Environment (Protection) Act, 1986.

In case of violation of directions, as specified in this Circular, Environmental Compensation may also be imposed in accordance with guidelines issued by CPCB under Plastic Waste (Management) Rules, 2016.

This Circular shall come into force from the 1st of July, 2022.

 

CONTROL ROOM

In July 2022 KSPCB gave the Office Order NoPCB/WMC/764/SUP-PLS/2022/ 2612 for the Establishment of State Control Room (SCR) to facilitate activities related to the effective implementation of SUP Ban

In compliance of the said directions, the Karnataka State Pollution Control Board has setup a Control Room # 49, Parisara Bhavan, Church Street, Bangalore-01.

• SCR shall become operational with effect from 05.07.2022 and facilitate activities related to effective implementation of SUP ban including the following;

i) Provide assistance, guidance, clarification and information as may be sought by various Stakeholders regarding ban on SUP items, which may include following;

• Specific items covered under / excluded from SUP ban

• Guidance for filling of complaints on SUP Public Grevuance App.

• Guidance for operational of SUP compliance monitoring portal by ULBs.

• Issues related to switching over to alternatives including issue of Consent/Registration under Plastic Waste Management Rules, 2016.

• Compostable plastic manufacturers details.

ii) The SCR shall monitor enforcement of SUP ban through ULBs and Regional Officers of KSPCB and report compliance status through SUP compliance monitor portal.

iii) The details of State Control Board are has given below;  

Alas, the established Control Room does not exist and Stakeholders are deprived of assistance, guidance, clarification and information  regarding ban on SUP items
